Guardianship

A guardianship is a legal mechanism that allows a qualified adult to make decisions on behalf of an incapacitated adult or a minor child. There are a few ways in which guardianships become necessary in family law:

  • If an incapacitated adult needs to finalize his or her divorce proceeding. This ensures that the incapacitated adult has a guardian in place to protect their best interests.
  • If parents of a child are either deceased or unable to care for their child, a willing and qualified adult may petition to establish guardianship.
  • If a child is disabled, a parent may need to establish guardianship once that child reaches the age of 18 to assist with the care and benefits available for the child.
